Welcome to TestifyNH. By using our service, you agree to these terms. Please read them carefully.

1. What TestifyNH Does

TestifyNH is a free service that helps people submit testimony to the NH General Court. When you use our service:

  • You provide your contact information, position on a bill, and optional written testimony
  • After you verify your email, we submit your testimony to the official NH General Court system on your behalf
  • Your testimony becomes part of the public legislative record

2. Authorization to Submit on Your Behalf

By submitting testimony through TestifyNH, you expressly authorize us to submit your testimony to the NH General Court on your behalf.

This authorization includes:

  • Submitting your name, contact information, position, and testimony content to the official NH General Court testimony submission system
  • Acting as your agent for the sole purpose of delivering your testimony to the appropriate legislative committee
  • Retrying submission if initial attempts fail due to technical issues

You may only revoke this authorization by canceling your submission before it is delivered to the NH General Court.

3. Eligibility

To use TestifyNH, you must:

  • Be at least 18 years old, or have parental consent
  • Provide accurate contact information, including your true residency status
  • Have a valid email address for verification

Note: The NH General Court accepts testimony from both New Hampshire residents and non-residents. You must accurately disclose your location when submitting testimony.

4. Your Responsibilities

When using TestifyNH, you agree to:

  • Provide accurate information: You certify that all information provided, including your name and town of residence, is true and accurate. You acknowledge that knowingly providing false information to a public servant is a violation of NH RSA 641:3 (Unsworn Falsification), a misdemeanor under New Hampshire law.
  • Submit your own testimony: You may only submit testimony that represents your own views. Do not submit testimony on behalf of others without their explicit authorization.
  • Avoid abuse: Do not use automated tools, submit spam, or attempt to flood the system with duplicate submissions.
  • Keep content appropriate: Your testimony should not contain threats, harassment, obscenity, or content that violates any law.

5. Public Record Acknowledgment

You understand and acknowledge that testimony submitted through TestifyNH becomes part of the public legislative record.

This means your name, town/city, position, and written testimony (if provided) will be visible to legislators, committee members, and the general public. This information cannot be removed once submitted to the NH General Court.

6. No Guarantee of Delivery

While we make every effort to successfully submit your testimony, we cannot guarantee that:

  • The NH General Court website will be available or functioning properly
  • Your testimony will be accepted by the NH General Court system
  • Submissions will be processed before hearing deadlines

We will notify you of your submission status. If your submission fails, you may need to submit directly through the NH General Court website.

7. Service Availability

TestifyNH is provided "as is" without warranties of any kind. We may:

  • Modify or discontinue the service at any time
  • Temporarily suspend service for maintenance
  • Limit submissions during high-volume periods

8. Account Suspension

We reserve the right to suspend or terminate your access to TestifyNH if you:

  • Violate these Terms of Service
  • Submit false or misleading information
  • Attempt to abuse, spam, or exploit the service
  • Engage in any activity that disrupts the service or harms other users

We reserve the right to suspend accounts engaged in coordinated efforts to obstruct the legislative process. Abuse of the service to intentionally flood or hinder committee functions may be reported to authorities as a violation of NH RSA 642:1 (Obstructing Government Administration).

9. Limitation of Liability and Indemnification

To the maximum extent permitted by law, TestifyNH and Trailside Analytics, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. This includes, but is not limited to:

  • Failed or delayed testimony submissions
  • Errors in submitted testimony
  • Any consequences of your testimony becoming part of the public record
  • Service interruptions or data loss

TestifyNH and Trailside Analytics, LLC are not responsible for the content, accuracy, or legality of the testimony provided by users.

Indemnification: You agree to indemnify and hold harmless TestifyNH and Trailside Analytics, LLC from any legal claims, fines, or expenses (including attorney fees) arising from the content of your testimony or any misrepresentation of your identity.

10. Privacy and Data Collection

Your use of TestifyNH is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

For security and legal compliance purposes, we log IP addresses associated with testimony submissions. This information may be used to investigate abuse, respond to legal requests, or verify the authenticity of submissions.

11. Changes to These Terms

We may update these Terms of Service from time to time. If we make significant changes, we will notify users through the website. Your continued use of TestifyNH after changes are posted constitutes acceptance of the updated terms.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms shall remain in full force and effect.

13. Governing Law

These terms are governed by the laws of the State of New Hampshire. Any disputes arising from your use of TestifyNH shall be resolved in the courts of New Hampshire.

14. Lobbyist Disclosure

TestifyNH is a technology platform and service provider. We do not act as a lobbyist (as defined in NH RSA 15) on your behalf. We do not edit, influence, or advocate for the positions you submit; we provide the technical means for you to deliver your own personal testimony.
